10. Business Closure
10.1 No Refunds upon Closure
In the event of CreateTheWeb ceasing operations or closing the business, we will not be obliged to provide refunds for any services rendered or fees paid by clients, in accordance with Section 5 of these Terms and Conditions.
10.2 Notice of Closure
Should we decide to close our business or cease operations, we will make every reasonable effort to notify clients in writing at least 30 days prior to the closure, allowing clients to make alternative arrangements for their ongoing projects or services.
10.3 Transfer of Services
In the event of a business closure, we may, at our discretion, transfer ongoing projects or services to another reputable provider, subject to the client's consent. Clients are not obliged to continue their services with the new provider and may choose to terminate their agreement in accordance with the terms outlined in Section 6 of these Terms and Conditions.
10.4 Intellectual Property
Upon closure of the business, any non-exclusive licences granted to clients for the use of our designs, content, and materials will remain in effect, subject to the terms of the original agreement. We will not be responsible for transferring any intellectual property rights to clients, unless explicitly agreed otherwise in writing.
10.5 Limitation of Liability
Our liability for any damages, losses, or claims arising from or related to the closure of our business shall be limited to the fees paid by the client for the specific service in question. We shall not be held liable for any consequential, incidental, indirect, or special damages, even if we have been advised of the possibility of such damages.
10.6 Third-Party Software Closure
If any of the companies providing software for the projects we work on cease operations or discontinue their services, we cannot provide any refunds or compensation.
