8. Liability

CreateTheWeb's liability for any direct damages arising from or in connection with the services provided under these Terms and Conditions shall be limited to the amount of fees paid by the client for the specific service in question. In no event shall CreateTheWeb, its employees, agents, or subcontractors be held liable for any consequential, incidental, indirect, or special damages, including but not limited to loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages.
8.2 Exclusion of Liability
CreateTheWeb shall not be held liable for any issues, damages, or losses resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, wars, civil unrest, labour disputes, government actions, or third-party failures.
8.3 No Warranty
While we strive to provide high-quality services and work diligently to meet our clients' expectations, we do not warrant or guarantee the performance, functionality, or results of our services. Clients use our services at their own risk, and we do not accept any liability for errors, omissions, or any other issues that may arise from the use of our services.
8.4 Indemnification
Clients agree to indemnify, defend, and hold harmless CreateTheWeb, its employees, agents, and subcontractors from and against any claims, damages, losses, or expenses, including reasonable legal fees, arising from or in connection with any breach of these Terms and Conditions by the client, any negligence or wilful misconduct by the client, or any third-party claims arising from the client's use of our services.
8.5 Professional Advice
The services provided by CreateTheWeb are not intended to replace professional advice, such as legal, financial, or technical consultations. We shall not be held liable for any decisions or actions taken by clients based on our services, and clients are responsible for obtaining independent professional advice where appropriate.
